Based at the Marbotte Plaza, the Côte-d'Or Chamber of Notaries is now one of three chambers of the Chambre interdépartementale des notaires de la cour d'appel de Dijon, which covers the departments of Côte-d'Or, Haute-Marne and Saône-et-Loire. The president of the interdepartmental chamber is assisted by three vice-presidents. This is a national reorganization that groups chambers by legal region. As far as the Côte d'Or is concerned, nothing has changed for the practical side of the notaries' clientele. Maître Nicolas Taiclet, notaire in Nuits-Saint-Georges, is vice-president of the Côte-d'Or.

In addition to the notary's institutional role in drafting real estate deeds and arbitrating family law disputes, he also has an often overlooked advisory role. With their technical, tax and legal knowledge, notaries can meet with you, usually free of charge, to advise you and answer your questions about the family, real estate price trends and the pitfalls to be avoided.

LA VENTE NOTARIALE INTERACTIVE - IMMO-INTERACTIF

The Chambre interdépartementale des notaires de la cour d'appel de Dijon, like the Notaires de France, is promoting a new way of selling real estate: the vente notariale interactive (VNI), also known as Immo-Interactif. The method is a kind of Internet auction, organized and secured by notaries who are members of the notarial real estate negotiation network. The seller and his notary determine the presentation value of the property, which corresponds to the price defined jointly during the appraisal, reduced by around 10 to 15%. The aim is to make the property attractive to buyers, but the seller is never obliged to sell below the appraisal price. The seller and his notary also define the conditions and timetable for the sale, and sign an exclusive mandate for a period of 45 days. During this period, the notary carries out a traditional sale process: online advertising on the www.immobilier.notaires.fr website (Immo-Interactif section), on various real estate websites, in the press and on billboards, and showing the property to potential buyers. During the visits, interested buyers receive electronic approval to participate in the online sale when the time comes. The sale then takes place over a 24-hour period, during which potential buyers who have received approval during their visit can formulate an offer to purchase. The process is totally transparent: seller and buyers can watch the bids being made online, and they appear in real time on the online sales floor. The seller has all the information on the buyers, and chooses the offer that suits him best, but which is not necessarily the most expensive. Indeed, some sellers prefer the security of the transaction to the price. He then signs a promesse de vente with his notary. Thanks to its speed and transparency, and because it is secured by the notary, the Immo-Interactif sale is perfectly suited to local authorities, associations, sales by people under guardianship, and also in conflict situations that sometimes arise in inheritance or divorce. Immo-interactif sales guarantee that the seller will sell at the market price.

CENTRE NOTARIAL DE MÉDIATION

Since March 2015, the Regional Council of Notaries of the Dijon Court of Appeal has inaugurated its Notarial Mediation Center.

This center offers assistance in the amicable resolution of a family, commercial, professional or neighborhood dispute through mediation. A mediator is appointed to facilitate dialogue between the parties, who find their own solutions. Less traumatic, faster and more economical than most legal procedures, the cost of a mediation is fixed by an hourly rate and a fixed amount of file fees, divided equally between the parties.

The 21st Century Justice Modernization Act, which came into effect at the end of 2016, reaffirmed the principle of justice favoring alternative dispute resolution through mediation.
